Most services, whether they are on the Internet or not, are covered by some form of terms and conditions. Set out below, are the terms and conditions for using the Webswappers Ltd swapping services. These terms and conditions exist to protect you as a user and to help prevent the site being used for anything that might be illegal or offensive, so please make sure you read them carefully. By registering with us, you are indicating your agreement to be bound by these terms.

1.   Description of the Service
1.1 We will provide you with an easy to use website that provides everybody with the means for swapping goods and services ("Service").

2.   Registering
2.1 You must make sure that all of the information that you provide, both on registration and afterwards, is true and accurate. We may stop you using the Service if you do not do this.

2.2 When you register, you will be requested to select a nickname, a password and a reminder word. You are responsible for all activities under your nickname and password. If you forget your password you can request a reminder by email, but if you discover that someone else is using your nickname and password without your permission, you must contact us immediately at info@swapitshop.com.

2.3 Once you have registered, you will be given a personal swap account so that you can immediately start using the Service. It is possible to browse the Service without registration.

We reserve the right to cancel or disable any membership if that Member has been inactive for a period of 12 consecutive months. "Inactive" shall be defined as lack of one of the following: website visit (click through); profile update; or any Swapits earning or spending transaction.

3.   Disclaimer of warranties and limitation of liabilities
PLEASE READ THE FOLLOWING SECTIONS VERY CAREFULLY. Webswappers Ltd is only responsible for providing the technical means for the swapping Service and does not check or endorse any of the products or services that are swapped or sold through the Service.

3.1 We shall not be responsible for any products or services swapped or sold using our Service, for any damage to products during transit, nor any misrepresentations and/or breaches of contract by persons using our Service.

3.2 In no circumstances will we be responsible for your loss of profits, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

3.3 We shall not be liable for any losses resulting from the use or the inability to use the Service or messages received of transactions entered into through the Service or resulting from unauthorised access to, or alteration of members transmissions of data in circumstances which are beyond our control.

3.4 We shall not be liable for our inability to provide any Swapits earning or redemption opportunities.

3.5 We cannot promise that the Service or the website will be uninterrupted or error free. Because of the nature of the Internet, the Service is provided on an "as available" basis. We will not be responsible to you if we are unable to provide the Service for any reason beyond our control.

4.   Swapits programme
4.1 Swapits ("Points") can be collected from promotional partners, promotions, offers and through trading on the site.

4.2 Points have no cash value and may be spent only as directed though the Service or via promotional partners.

4.3 Unredeemed Points will expire 36 calendar months after collection.

4.4 We reserve the right to terminate or disable, at our sole discretion, any Programme membership if we reasonably believe such Member has violated or acted inconsistently with the rules of the Programme or this Agreement. The Member understands and agrees termination of membership will result in the cancellation of all of Member's Points.

4.5 We shall be the sole determiner in cases of suspected abuse, fraud, or violation of our terms and any decision relating to termination of membership (including cancellation of Points) shall be final and binding.

4.6 Points will only be transferable with our express consent and such consent will be at our sole discretion.

5.   Your conduct
5.1 You are solely responsible for the contents of your transmissions through the Service. You must ensure that your participation in the swapping of products and services does not violate any applicable laws or regulations. By this, we mean that you must check that you are entitled to swap the relevant item and that you are not prohibited from doing so by any law or regulation. In particular, you may not swap anything, which is illegal, which requires a license to buy or sell (for instance firearms, alcohol or pharmaceutical drugs) or which requires you to obtain an export license.

5.2 You must not transmit through the Service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise breach any applicable law or regulation. You must not attempt to gain unauthorised access to our computer system or the computer systems of any other member.

6.   Modifications to the terms and operating rules
6.1 We may change these terms or introduce specific new operating rules. All amended terms shall automatically be effective 30 days from when they are posted on the website. We will email these amendments to you at the email address you have provided. If we hear nothing back from you, your use of the website after the posting of an amendment implies your consent to the amended terms.

6.2 If you do not wish to accept the new terms of Service or the new operating rules you should not continue to use the Service. If you continue to use the Service after the date the change comes into effect, your use of the Service indicates your agreement to be bound by the new terms of Service or operating rules.

7.   General
7.1 All rights in the designs and information on the website are owned by Webswappers Ltd (or its affiliates). They are protected by copyright, trademarks and other intellectual property rights. You may not use the materials on our website for any purpose other than to use the Service.

7.2 We will use the information you provide and the records of how you behave on the website to constantly monitor and improve our Service in accordance with our privacy policy.

7.3 The site contains links to other websites which are not under the control of and are not maintained by us. We are not responsible for the content of those sites.

7.4 We reserve the right to recategorise or delete any swaps that are incorrectly categorised or we deem offensive or inappropriate in content.

7.5 We may change or withdraw any swap or part of our website, or refuse you access to the site at any time if we consider it necessary.

7.6 These terms of Service shall be governed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
